What are the conditions for claiming a 3% SDLT Surcharge Refund?

As per para 3 of Schedule 15 of Finance Act 2003, there are two parts to the replacement of a purchasers' main residence:

Condition 1: New Dwelling

Condition 1: New Dwelling

You must have bought your new main dwelling on or after 1 April 2016. The new dwelling acquired must be intended to be occupied as the individual’s only or main residence.

Condition 3: Sale of Previous Dwelling

Condition 3: Sale of Previous Dwelling

The sale of your previous main dwelling must complete within three years of the purchase of your new main residence.

Condition 2: Previous Dwelling

Condition 2: Previous Dwelling

You must have sold your previous main dwelling on or after 1 April 2016. You must have owned and occupied your previous main dwelling as your main residence.
